1. Formation of the contract, content of the contract, termination of use

Unless otherwise stipulated in the specific order process, a contract is concluded upon payment of the advance invoice. FAIR FLY reserves the right to refuse a contractual relationship in individual cases.
Upon conclusion of the contract, the client acquires the right to use the current version of FAIR FLY on https://fair-fly.de for flying sites which are directly licensed to him or which he is allowed to use on the basis of a cooperation agreement with the site owner.


2. Responsibility of the client

The client assures and ensures that the flying sites operated by him or used in cooperation are operated or used in accordance with the legal requirements. The responsibility for information and data on the respective sites lies exclusively with the client. Within the scope of his responsibility as site operator, the latter assures to regularly check their validity and to ensure that flight safety is guaranteed.
FAIR FLY reserves the right to block and/or terminate the client without notice in the event of a violation or the concrete suspicion of a violation and to retain invoice amounts paid in advance.


3. Confidentiality and data protection

FAIR FLY shall treat the data provided by the client as confidential. All data will be deleted or destroyed in accordance with legal regulations.
By placing the order the client confirms to have a binding data protection declaration in which the storage of personal data of third parties (club or guest pilots) is regulated according to GDPR (German DSGVO) and to make it accessible to them.
The client must ensure that the access data provided to him by FAIR FLY is not made available to unauthorized third parties. FAIR FLY shall not be liable for any damage caused by insufficient protection of the access data. FAIR FLY reserves the right to give information in case of misuse or suspicion of misuse as far as FAIR FLY is requested to do so by authorities, courts or persons.


4. Remuneration, billing and price changes

Billing is based on the FAIR FLY price list valid at the time. Price increases shall be announced with one month’s notice and shall not be applicable retroactively. Separate agreements may be made for special services.


5. Liability

Both contracting parties are aware of the fact that a hundred percent reliability of technical systems cannot be guaranteed. FAIR FLY shall not be liable for system failures in data centers, in internet services or in transmission facilities of infrastructure and network operators or any other hardware and/or software failure for which FAIR FLY is not responsible. This applies in particular to all cases of force majeure, such as power failures, computer failures due to computer viruses, etc.

6. Place of jurisdiction

The place of jurisdiction is Cologne.
